Collaborative law in a divorce? Sure! We'll show you how it works

If you're a Fort Lauderdale resident who finds yourself in the midst of divorce, it can be very demoralizing to keep slinging and dodging barbs in court. If the two of you have children — even adult children — these acrimonious proceedings can destroy family ties, perhaps even permanently.

That's why we often recommend collaborative law options for our divorcing clients. Don't think of it as limiting your options. Instead, it enhances the possibility that the two of you can meet on common ground — at least for some of your issues.

For instance, let's say you've been battling over custody of the kids. Neither of you want to cede primary custody to the other. We can help you work out issues that can lead to a reasonable compromise between co-parents.

This is helpful on several fronts, but the most important is that your children won't see the two of you at loggerheads on all parenting decisions. Instead, they can glimpse the two of you as united parental units working together for the best outcomes for them. That's a win-win for everybody.

To be sure, not all couples or all issues are a good fit for collaborative law practices. If one spouse has been abused by the other, we don't recommend using these tactics because the balance of power is too unequal. The abusive spouse can pressure or coerce the victimized spouse into making concessions that are not in their best interests or the best interests of the children.
