Appealing A Court Decision

While a presumption of correctness is assumed with all court rulings, sometimes courts come to the wrong conclusion in their rulings.

In such cases, either party in a divorce matter has the right to appeal that ruling within 30 days following a decision by a judge or magistrate in Florida family court.

Assuming an error was made in the trial court's determination, or an abuse of discretion can be proven, the trial court's decision then can be appealed to the Appellate Court.

The threshold for appealing a decision is very high and usually is based upon the court not making the appropriate findings.
